RECOMMENDED CITY COUNCIL ACTION:
• Approval of the proposed Resolution.
ITEM SUMMARY:
• This amended facilities agreement with Timber Creek Properties provides for construction of Bloomdale Road and Hardin Boulevard, dedication of parkland, and payment of parkland fees associated with the Timber Creek development.
• The developer will complete construction of the Bloomdale Road and Hardin Boulevard intersection within 120 calendar days of the execution of this agreement, including the “missing” 500 feet of Hardin Boulevard just south of Bloomdale Road.
• The City will receive an assignable contract and a development bond for the Bloomdale & Hardin intersection to guarantee completion if the developer fails to do so within the allotted time.
• The developer will complete construction of two lanes of Bloomdale Road along their northern boundary within 30 months of the execution of this agreement. A portion of Bloomdale Road overlaps with the US 380 Bypass and will be built to a modified standard due to its shorter expected service life.
• The City will receive a development bond for the remainder of Bloomdale Road to guarantee completion if the developer fails to do so within the allotted time.
• An 11-acre park tract will be dedicated to the City to satisfy a portion of the parkland dedication requirements for Timber Creek. A portion of this parkland is a Corps of Engineers conservation area that will be improved with walking trails and other low impact features prior to dedication. A pavilion and parking area will be built outside the conservation area.
• An additional parkland dedication of 5 acres was required with the original facilities agreement but is no longer acceptable to the City because a portion of it is proposed to be acquired for the US 380 Bypass. The developer will pay parkland dedication fees for this 5-acres.
• A hike & bike trail crossing under Bloomdale Road to connect to Erwin Park was required with the original facilities agreement but has been removed due to impacts of the US 380 Bypass. Staff will work with TxDOT to include a hike & bike trail under a proposed bridge at this same location.
BACKGROUND INFORMATION:
• Timber Creek and their predecessors entered into their original agreement with the City in October 2002 and the first amendment in May 2013.
• Timber Creek has been in default of the first amendment since May 2023 and further development was been paused while this amendment was being discussed.
