RECOMMENDED CITY COUNCIL ACTION:                     

                     Approval of the Resolution

 

ITEM SUMMARY: 

                     This Resolution approves and authorizes the application of the City’s third permit term Stormwater Management Program (SWMP) as drafted, and its submittal to the Texas Commission on Environmental Quality (TCEQ) as required by the TXR04000 General Permit.

 

BACKGROUND INFORMATION: 

                     On August 13, 2007, TCEQ issued the first term, 5-year Municipal Stormwater, General Permit.

                     As required, McKinney developed a SWMP in accordance with the requirements of the TPDES General Permit, and the SWMP was approved by Council on December 18, 2007, and TCEQ on December 22, 2008.

                     The SWMP was fully implemented by McKinney staff as well as the second developed SWMP relating to the second term, 5-year Municipal Stormwater, General Permit, which was issued on December 13, 2013.

                     TCEQ issued the third term, 5-year Municipal Stormwater, General Permit on January 24, 2019. 

                     McKinney has 180 days to reapply for coverage under the General Permit.

                     As required, McKinney has developed a revised SWMP in accordance with updated requirements and guidelines of the new TPDES General Permit.

                     The SWMP will require specific Best Management Practices (BMP’s) to be implemented by multiple City departments.

                     The SWMP has been developed to:

o                     reduce the discharge of pollutants from the City’s MS4 to the maximum extent practicable (MEP);

o                     protect water quality; and

o                     satisfy the appropriate water quality requirements of the Clean Water Act and the Texas Water Code.

                     TCEQ will require every component of each submitted and approved BMP to be implemented as indicated within the SWMP.

                     The SWMP must be fully implemented by the fifth permit year.

                     It is believed that this SWMP meets all General Permit requirements without obligating the City to additional requirements beyond it’s fiscal capability.

                     The General Permit does not restrict municipalities from performing additional stormwater efforts not included in the submitted and approved SWMP.

 

FINANCIAL SUMMARY: 

                     Funding of this program has been considered with regard to the budgets of Engineering, Public Works, as well as the Surface Water Drainage Utility System fee.
