RECOMMENDED CITY COUNCIL ACTION:

                     Approval of Resolution.

 

ITEM SUMMARY:

                     This Resolution authorizes the City Manager to execute a contract in the amount of $435,000, as well as all required supplemental agreements thereto, with Kimley-Horn and Associates, Inc. for professional consulting engineering services for the Lower 5 Plaza Infrastructure Improvements Project (CIP Project ST2234), for a total aggregate contract amount, inclusive of any supplemental agreements, not to exceed $475,000.

 

BACKGROUND INFORMATION:

                     The FY24 Capital Improvement Plan budget includes funding under CIP Project ST2234 for the preliminary bridge layout and drainage design related to the Lower 5 Plaza located at State Highway 5 (SH 5) between Virginia Street and Louisiana Street.

                     On April 18, 2023, City’s engineering staff presented an update at the City Council Work Session meeting on the SH 5 Downtown Pedestrian Connection Feasibility Study and City Council provided direction to move forward with the Inverted Deck Park currently referred to as the ‘Lower 5 Plaza’.

                     The infrastructure improvements for the Lower 5 Plaza under this contract generally include:

o                     Preliminary Bridge Layout

o                     Preliminary Drainage Design

o                     Preliminary Park Layout and Grading

o                     Public Engagement

                     The intent of the Lower 5 Plaza Infrastructure Improvements is to provide a bridge layout to the Texas Department of Transportation (TxDOT) to prepare final construction plans as well as lead the environmental evaluation/clearance process and ROW acquisition efforts as part of the SH 5 Roadway Improvements from McMakin Street to Power House Street.

                     The Lower 5 Plaza Infrastructure Improvements will incorporate the Lower 5 Plaza Park Improvements under a separate contract with Kimley Horn and Associates, Inc. (CIP Project PK2234). The Lower 5 Plaza Park Improvements will help establish a park design framework to illustrate preliminary park concept and general layout that complements the Lower 5 Plaza Infrastructure Improvements.

                     Funding for this project will be provided utilizing local funding, however, NCTCOG has committed to offsetting this cost through increasing regional funding participation on another City CIP project in the same amount.

                     Kimley Horn and Associates, Inc. submitted a response to 21-41RFQ for On-call Roadway Design Services and 21-42RFQ for On-call Utility Design Services.  The City pre-qualified Kimley Horn and Associates, Inc. (City Council Item October 7, 2021) for on-call services for both RFQ’s. Kimley-Horn and Associates, Inc. also previously completed the feasibility study and preliminary conceptual design efforts related to SH 5 Downtown Pedestrian Connection under CIP Project ST2234.

                     Kimley-Horn and Associates, Inc. submitted a proposal for this project in the amount of $435,000 which has been reviewed by staff and is recommended for approval.

                     All services provided under this contract are structured as special services to be billed on an hourly basis (not to exceed), which provides the City flexibility as the study progresses.

                     Staff is requesting an establishment of a $475,000 not to exceed contract authorization in the event additional professional services are justified and to expedite any necessary supplemental agreements deemed necessary.

                     Pending approval of this item, design efforts would begin immediately with preliminary bridge layouts and drainage design expected to be completed in the first quarter of 2024.

FINANCIAL SUMMARY:

                     This Resolution authorizes a design contract and any necessary supplemental agreements with Kimley-Horn and Associates, Inc. for an amount not to exceed $475,000.

                     With the approval of this item, $1,508.86 will remain in project ST2234.
