RECOMMENDED CITY COUNCIL ACTION:
· Adopt Ordinance

ITEM SUMMARY:
· The amended ordinance establishes provisions, such as:
· Requiring that a database be maintained by a secondary metals recycler of each purchase transaction;
· Witten documentation evidencing that the seller is the legal owner, or is lawfully entitled to sell the metal property;
· A person selling or attempting to sell the regulated metal property to a secondary metals recycler be required to provide certain information;
· Hours that a secondary metals recycler shall conduct all purchase transactions;
· Placing a five-day (5) hold on regulated metal property, unless the property is released sooner by written order of the Chief of Police or by order a court of competent jurisdiction
· Placing a hold notice on reasonably suspected stolen regulated metal property;
· Requiring a person who conducts business as a secondary metals recycler in McKinney, Texas acquire a license by September 1, 2011 or for any business that opens after September 1, 2011;
· Each license will expire one (1) year from date of issuance and may be renewed only after making application
· The Chief of Police shall issue a license to an applicant within thirty (30) days after receipt of application; if approved;
· An appeal process should the Chief of Police deny the issuance of a license or revokes a license

· This ordinance is a sister ordinance to the Collin County Metal Recyclers Ordinance;
