Consider/Discuss an Appeal of a Drainage Maintenance Policy Decision Regarding Erosion at the Provence Townhomes

RECOMMENDED CITY COUNCIL ACTION:

                     Receive presentation and discuss an appeal of a decision about creek erosion at the Provence Townhomes.

 

ITEM SUMMARY:

                     The current McKinney Drainage Maintenance Policy was approved by a resolution of City Council on November 1, 2016.  The policy includes guidance as to if/when the City will address erosion hazards.

                     In 2005, a retention pond was built by Stonebridge Ranch with grouted rock riprap for slope protection.

                     In 2016, phase 1 of the Provence Townhomes were built.

                     In 2017, the grouted rock riprap had begun to fail.

                     In 2021, erosion began to cut upstream onto Provence HOA common area property.

                     In 2024, the Provence HOA and the Stonebridge Ranch HOA asked the City for assistance.  The City responded by stating that erosion is a natural phenomenon and it’s up to private property owners to address erosion on their property how they see fit.  Per City policy, the City only steps in if public infrastructure is threatened (not the case here) or if permitted private structures are threatened (also not the case here).

                     The Provence HOA is appealing that decision.
