RECOMMENDED CITY COUNCIL ACTION: Staff recommends approval of the proposed right-of-way vacation with the following condition:

 

1.                     The City of McKinney reserves an exclusive, perpetual utility easement within the entirety of the vacated prescriptive right-of-way. 

 

ITEM SUMMARY: 

 

                     The applicant is proposing to vacate a variable width right-of-way located between Virginia Street and Ridge Road.  At present, the entire portion of this right-of-way proposed to be vacated is unimproved, since the four lanes of Ridge Road have been constructed in the new alignment.  None of the adjacent residential or non-residential lots use the right-of-way for access and all the adjacent property owners of these lots have signed the petition to vacate the right-of-way.

 

BOARD OR COMMISSION RECOMMENDATION:                     

 

                     On May 25, 2010, the Planning and Zoning Commission voted unanimously to recommend approval of the proposed right-of-way vacation.
