RECOMMENDED CITY COUNCIL ACTION:
· Approval of Resolution.

ITEM SUMMARY:
· This resolution authorizes a contract with Dallas, Garland, and Northeastern Railroad, Inc., (DGNO) for railroad track repair work along the DART railroad line near Railroad Street and Smith Street, for an amount not to exceed $64,000.

BACKGROUND INFORMATION:
· The Capital Improvements Program includes a project for the reconstruction of the streets in the vicinity of Smith Street and Railroad Street.
· This project required the construction of double 10 x 4 box culverts crossing under the railroad.
· In August 2008, during the construction of these box culverts, a significant rain event flooded the area resulting in a slope failure at the DART railroad embankment.
· The embankment was temporarily shored with steel beams and steel plates to stabilize the slope failure area until a permanent solution was developed.
· A repair plan that involves removing and recompacting the unstable soil has been accepted by all parties.
· This contract includes the removal and replacement of a section of track as necessary to allow the recompaction work to occur.
· The railroad property is owned by DART and the rail is operated and maintained by DGNO; therefore, DGNO has submitted a proposal, in the amount of $53,565.66, to perform this work.

FINANCIAL SUMMARY:
· This resolution authorizes a contract with DGNO, for an amount not to exceed $64,000.
· Because of the age of the track that is being removed and replaced, some of the materials may not be suitable to be reused; therefore, the contingency amount is ...
