RECOMMENDED CITY COUNCIL ACTION:

                     Approval of the proposed ordinance.

ITEM SUMMARY:

                     Staff is proposing an amendment to Chapter 70, Section 70-59 (Health and Safety Code) of the Code of Ordinance pertaining to the requirements for our notice of violation for issues such as high grass and weeds, refuse, and trees/vegetation on or over a public right of way.  Staff is proposing amendments to the Code of Ordinances to make our ordinance consistent with state law thereby eliminating confusion while also streamlining the notification process.  Additionally, the amendment will result in a significant cost savings to the city.

 

BACKGROUND INFORMATION:

                     Currently our ordinance requires the Notice of Violation to be sent certified, whereas the current state law does not.
