RECOMMENDED CITY COUNCIL ACTION: Approval of the Resolution.

ITEM SUMMARY:
· On December 1, 2009, City Council approved a resolution authorizing the City to submit a nomination for a Statewide Transportation Enhancement Program to construct a hike and bike trail from Malvern Elementary School to Towne Lake Park.
· The City’s approved resolution was disapproved by TxDOT with a requirement to provide specific language which is due by January 12, 2010, thus necessitating a quick request for City Council action.
· Specifically, TxDOT requires that the resolution states that the City should “commit to the project’s development, implementation, construction, maintenance, management and financing”.
· Additionally, the resolution must state that the City commits to providing funds for both the local match and 100% of any cost overruns, should that occur.
· The Comegy’s Hike and Bike trail will begin at Malvern Elementary School paralleling Park Central Drive then turn northbound along the US 75 service road. The trail will meander north through the grove of old growth hardwood trees to connect with the existing trail that crosses Wilson Creek leading to Towne Lake. A connection to McKinney Community Center will also be made.
· Projects selected are eligible for reimbursement of up to 80% of allowable costs.
· The approximate cost of the Comegy’s Hike and Bike Trail is $749, 906.

o $599, 925 TxDOT reimbursement

· TxDOT will announce the successful projects in December of 2010.
