RECOMMENDED CITY COUNCIL ACTION:
* Approval of the proposed Resolution.

ITEM SUMMARY:
* This amended facilities agreement with Timber Creek Properties provides for construction of Bloomdale Road and Hardin Boulevard, dedication of parkland, and payment of parkland fees associated with the Timber Creek development.
* The developer will complete construction of the Bloomdale Road and Hardin Boulevard intersection within 120 calendar days of the execution of this agreement, including the "missing" 500 feet of Hardin Boulevard just south of Bloomdale Road.
* The City will receive an assignable contract and a development bond for the Bloomdale & Hardin intersection to guarantee completion if the developer fails to do so within the allotted time.
* The developer will complete construction of two lanes of Bloomdale Road along their northern boundary within 30 months of the execution of this agreement. A portion of Bloomdale Road overlaps with the US 380 Bypass and will be built to a modified standard due to its shorter expected service life.
* The City will receive a development bond for the remainder of Bloomdale Road to guarantee completion if the developer fails to do so within the allotted time.
* An 11-acre park tract will be dedicated to the City to satisfy a portion of the parkland dedication requirements for Timber Creek. A portion of this parkland is a Corps of Engineers conservation area ...
