RECOMMENDED CITY COUNCIL ACTION:                     

                     Direct City Staff to prepare a service plan which will govern the provision of municipal services to the areas which are to be annexed by the City of McKinney.

 

ITEM SUMMARY: 

                     A number of properties totaling approximately 3,821 acres, generally located in the Northwest Sector of McKinney have been identified for annexation into the City of McKinney’s corporate limits. These properties are more fully depicted on the attached location map.

 

                     Annexation proceedings for the identified properties have been initiated by the City of McKinney in an effort to implement the goals and strategies identified by City Council to provide direction for strategic and economic growth.

 

                     In accordance with Section 43.056 of the Texas Local Government Code, a municipality proposing an annexation shall complete a service plan that outlines the provision of full municipal services (example: police protection, fire protection, emergency medical services, solid waste collection, water and wastewater services, roads, parks, etc.) for the area to be annexed.

 

                     This service plan will be drafted in accordance with State Law and will be provided for inspection at the following City Council regular and special meetings:

 

o                     October 16, 2017 @ 5:30 p.m. - First public hearing regarding the proposed annexation

o                     October 17, 2017 @ 6:00 p.m. - Second public hearing regarding the proposed annexation

o                     November 7, 2017 @ 6:00 p.m. - Final reading of the annexation ordinance including anticipated adoption of ordinance and service plan

 

                     All of the meetings indicated above will occur at Jack Hatchell Collin County Administration Building, 4th Floor, Commissioners Court, 2300 Bloomdale Rd., McKinney, TX 75071, unless otherwise noted on the published agenda for each meeting.

 

BACKGROUND INFORMATION: 

                     The annexation of land is governed by Section 43 of the Texas Local Government Code. This code section outlines the steps and procedures that must be followed in order to incorporate land that is within a municipality’s extraterritorial jurisdiction (ETJ) into its corporate city limits. The proposed annexation is following these statutory obligations.

 

                     However, earlier this year, the Texas Legislature approved Senate Bill 6, which modifies the provisions for carrying out municipal annexations in Texas. These changes in State Law will go into effect later this year.

 

                     As such, City Council has considered four potential approaches for carrying out municipal annexations for the remainder of 2017 in conformance with the existing provisions of Chapter 43 of the Texas Local Government Code. These approaches included:

 

o                     Option A: do not conduct municipal annexations in 2017

 

o                     Option B: conduct municipal annexations in support of specifically identified roadway and bridge improvement projects

 

o                     Option C: conduct municipal annexations in support of identified roadway, water and sewer improvement projects

 

o                     Option D: conduct municipal annexations in alignment with anticipated growth corridors and development pressures

 

                     During the August 28th Special Meeting, Council approved Resolution 2017-08-160, identifying Option D as the preferred approach for municipal annexations in 2017. As part of this, portions of the McKinney Extraterritorial Jurisdiction (ETJ) generally located in the Northwest Sector of McKinney have been identified for annexation into the corporate limits.

 

 

FINANCIAL SUMMARY: 

                     If the properties identified for annexation are, in fact, annexed into the City of McKinney, they will begin to pay ad valorem taxes (property taxes) to the City of McKinney on an annual basis, except for those property owners that have executed a development agreement.

 

                     Additionally, upon annexation, the City will be obligated to provide full municipal services as outlined in the service plan that is to be created subsequent to the City Council’s direction.

 

BOARD OR COMMISSION RECOMMENDATION:

                     Neither the creation of a service plan nor the annexation of land into the City’s corporate limits requires any board or commission recommendations.
