RECOMMENDED CITY COUNCIL ACTION:
* Approval of the Resolution

ITEM SUMMARY:
* This item authorizes the City Manager to enter into an agreement with SLC McKinney Partners, L.P., regarding the reimbursement of construction costs incurred by the oversizing of a master planned wastewater main.

* The contract price of the items associated with the oversized main and related appurtenances is $235,421.89.

* The proposed agreement stipulates that the City agrees to participate in the cost of construction for the oversized portion of the wastewater main (24" diameter), up to $147,268.57, which is the estimated difference between the costs of the oversized main and the cost to construct the City's minimum standard 12" diameter main that would otherwise be sufficient to serve the Tucker Hill, Phase 4 Subdivision.

* If the actual cost of the oversized main exceeds the estimated cost difference, the agreement states the City will agree in writing, subject to the availability of funds, to an increased level of participation in an amount up to the actual cost of the oversized main.

* In no circumstances shall the City's participation in costs exceed the difference between the cost to construct the standard 12" diameter line and the cost to construct the 24" diameter oversized main.
