RECOMMENDED CITY COUNCIL ACTION:
• Approval of the Resolution and the Board of Adjustment Rules of Procedure
ITEM SUMMARY:
• Tex. Loc. Gov’t Code § 211.008 was recently changed by the Texas Legislature to require that any rules adopted by a board of adjustment in accordance with Tex. Loc. Gov’t Code Chapter 211 must be approved by the governing body.
• By passing the Resolution, the City Council will be approving the Rules of Procedure used by the McKinney Board of Adjustment for its meetings as well as public hearings related to appeals of administrative decisions, variances, and amortizations, in accordance with Section 146-165 of the Code of Ordinances, City of McKinney, Texas.
• The Resolution also authorizes the Board of Adjustment to adopt the Rules of Procedure.
