RECOMMENDED CITY COUNCIL ACTION: Approval

 

ITEM SUMMARY:

  • The Resolution authorizes settlement of the ongoing PUCT Rate Case filed by the Petitioning Cities of Plano, Garland, Mesquite, and Richardson by amending the current water delivery contract between the thirteen (13) Member Cities. 
  • The amendment will establish a new wholesale water rate framework to be implemented by the NTMWD over the next thirteen (13) years.
  • The amendment further provides that no new wholesale rate cases may be brought by any of the Member Cities for a period of 20 years.
  • A portion of the McKinney’s litigation expenses are being paid by the NTMWD incident to the approval of the amendment.
  • All of the Member Cities will be adopting approvals in conjunction with the agreed terms of the settlement and amendments.
