ITEM SUMMARY:
* The City of McKinney operates and maintains eight (8) elevated storage tanks in its water distribution system. The Public Works Department and City Attorney have developed a license agreement to replace existing lease agreements for companies utilizing the elevated storage tanks for communications infrastructure.
BACKGROUND INFORMATION:
* The City of McKinney has 19 lease agreements with cell phone provides to allow access to the elevated storage tanks communication equipment.
* Many of the historical lease agreements were drafted by private communication providers. These leases were drafted like antenna tower leases and were changed for different entities and different locations. The agreements do not offer equal coverage or comparable rights for the city.
* A new license agreement is proposed for use when allowing communications equipment on elevated storage tanks.
* The Public Works Department and the City Attorney met with communications providers regarding the new license language over the past 3 years.
* The new license agreement will go into effect at the end of the existing leases or when the existing lease allows, i.e. a lessee equipment change-out.
* Of the 19 existing lease agreements, there are currently 4 expired lease agreements. Notice has been provided to the lessee on each of these agreements about the expiration and the new license agreement has been provided.
