ITEM SUMMARY:
* An Interlocal Agreement between the City of McKinney and the Dallas Area Rapid Transit Mobility Service Local Government Corporation is required to begin transit service in the McKinney Urbanized Area (MUZA) starting January 1, 2022. In addition thereto, a separate, related Interlocal Agreement between the City of McKinney and Dallas Area Rapid Transit (DART) and Dallas Area Rapid Transit Mobility Service Local Government Corporation for use of the GoPass application is also needed to commence service.
* At the August 18, 2021 meeting, the MUTD approved the DART proposal that is further defined in the agreements.
* Drafts of these interlocal agreements are currently under review by Legal.
* In order to maintain a service start date of January 1, 2022, MUTD review is requested for September 22, 2021 in order for the documents to be reviewed by the DART board at their meeting on September 28, 2021.
* The Interlocal Agreements are still under review and copies will be provided to Board Members at the meeting.
* Staff recommends conditional approval of the Interlocal Agreements, which approval would be expressly conditioned upon full concurrence on the contract language by the attorneys of the respective parties. Should the attorneys not concur, the Interlocal Agreement(s) shall be placed on a subsequent MUTD agenda for further consideration and direction to staff.
