RECOMMENDED CITY COUNCIL ACTION:
* Approve the proposed ordinance amendments.

ITEM SUMMARY:
* Staff is proposing to modify the City of McKinney's Noise Ordinance (Chapter 70, Article V) of the Code of Ordinances to better regulate the use of sound amplification devices on public property.

* McKinney's historic downtown continues to grow and become a popular destination. Recently, Downtown has experienced a dramatic increase in non-permitted performers utilizing amplified sound.

* The non-permitted amplified sound conflicts with permitted performances and business outdoor patio environments. While we encourage a lively and dynamic Downtown environment, the amplification of performances creates a distracting and unpleasant experience.

* Staff is proposing to modify Section 70-120(b)(2) to prohibit the use of sound amplification devices on public property including sidewalks, roads, and MPAC property. Exemptions are proposed for special events or for amplified sound being produced by the city. Examples might include special events in our historic downtown or the speakers mounted to downtown light poles.

* Staff will continue to monitor activities downtown but believe that the proposed amendments will allow for non-amplified sound from street performers to continue while also protecting our historic downtown's visitors from the negative impacts of amplified sound. As such, staff is recommending approval of the proposed amendments.
