ITEM SUMMARY:
• The May 6, 2023 General Election for City Council Member consists of ballot measures to determine Council Members for District 2, District 4, and At-Large #2.
• Rick Franklin was the only person to apply for a place on the ballot of the race for Council Member District 4.
• Approval of this ordinance will declare Rick Franklin elected to the office of City Council Member for District 4, in accordance with Texas Election Code, Chapter 2, Subchapter C.
• Under Texas Election Code, Sec. 2.053
o A candidate certified to be unopposed shall be declared elected to office
o The name of the unopposed candidate shall appear on the election ballot under the heading of “Unopposed Candidates Declared Elected”
o A certificate of election shall be issued to the unopposed candidate in the same manner and at the same time as provided for a candidate elected at the election.
