RECOMMENDED CITY COUNCIL ACTION:
* Approval of the Resolution.

ITEM SUMMARY:
* City Council previously approved a Facilities Agreement on this property on July 24, 2017, and the agreement was recorded in the Deed Records of Collin County on July 28, 2017. The agreement limited uses on the property to one single family home in exchange for variances on certain infrastructure requirements.

* Templo Pentecostal purchased the property from the previous owner and signatory on the agreement approximately two weeks after recordation of the Facilities Agreement as evidenced by a deed recorded in the Deed Records of Collin County on August 10, 2017.

* Templo Pentecostal first learned of the agreement approximately two years after purchase and has approached staff several times since then to discuss modifications to the Facilities Agreement to allow construction of a church on the property. At such times, however, there was not yet a firm plan for their church building.

* Templo Pentecostal has since developed plans for a first phase consisting of a 6,000 square foot church with plans to expand in the future to 12,000 square feet. Although infrastructure is lacking in this area, staff recommends approval of the amendment due to the site's remote nature and long distance from any City infrastructure.
