ITEM SUMMARY:
• This Resolution authorizes the City Manager to execute a contract and all necessary change orders with ANA Site Construction, LLC, for the Construction of the SH 5 Utility Relocations Project (CIP Projects WA1633 and WW1633) for a total contract amount not to exceed $19,770,000.
BACKGROUND INFORMATION:
• Kimley-Horn and Associates, Inc. prepared the construction plans for the SH 5 Utility Relocations Project (CIP Projects WA1633 and WW1633).
• TxDOT’s design for SH 5 roadway improvements from Spur 399 to Power House Street is underway referenced as CSJ 0047-05-054.
• The planned improvements to SH 5 include a complete reconstruction as a 4-to 6-lane divided roadway. Construction of the planned improvements is estimated to begin in 2025 following City of McKinney relocation of water/wastewater facilities and TxDOT acquisition of necessary right-of-way.
• The SH 5 Utility Relocations (Power House Street to Spur 399) Project (CIP Projects WA1633 and WW1633) consists of required relocations and betterment of existing city water distribution mains and wastewater collection lines which have been identified to be in conflict with the proposed improvements to SH 5 by TxDOT.
• There are approximately 23,450 linear feet of proposed water distribution mains ranging in sizes 8 - 24 inches and approximately 10,700 linear feet of proposed wastewater collection lines ranging in sizes 8 - 18 inches within the project limits.
• Several permanent easements and temporary construction easements have been acquired in areas where the space is limited for the relocated water and wastewater lines along the project limits. The City continues to acquire easements from the remaining properties within the project limits.
• The City issued invitations to bid (24-35CC) to solicit responses from qualified contractors for the construction of the SH 5 Utility Relocations Project (CIP Projects WA1633 and WW1633).

o 1,098 matching eBid Supplier Notifications which included fifty (50) Historically Underutilized Business (HUB) suppliers
• The bid included a Base Bid and an Alternate Bid which would allow the City to evaluate the construction of certain water and wastewater PVC pipes in steel casings in the Base Bid or substitute with fusible PVC pipes in reduced size steel casings (Alternate Bid) in accordance with Engineering requirements.
• Out of 1,098 supplier notifications, six (6) bids were received and opened by Procurement Services on March 7, 2024. The following is a summary of the bids:

• ANA Site Construction, LLC, submitted the low bid in the amount of $16,394,286.50 for the Base Bid, and $15,817,047.50 for the Alternate Bid.
• Based on the alternate bid amount submitted by ANA Site Construction, LLC, an award is recommended for the Alternate Bid due to the price differential, durability, and reduced maintenance requirements of fusible PVC.
• ANA Site Construction, LLC, submitted references and qualifications that were verified in accordance with the bid specifications as shown in the attached letter of recommendation.
• The contract documents require that this project reach an overall Final Completion within 730 calendar days after issuance of the Notice to Proceed. This project includes two major milestone completion dates as follows:
o Spur 399 to Dorsey Street - 365 Calendar Days
o Dorsey Street to Power House Street - 730 Calendar Days
• Pending authorization to execute this construction contract with ANA Site Construction, LLC, notice to proceed for the project is expected to be issued in May 2024, and construction is expected to be completed by May 2026.
• There is an accompanying item on the Council Agenda for the project authorizing a contract for materials testing.
FINANCIAL SUMMARY:
• This Resolution authorizes a contract and all necessary change orders with ANA Site Construction, LLC, for an amount not to exceed $19,770,000.
• Funding for this contract is included in the Capital Improvements Program (WA1633 and WW1633)
o WA1633 (Fund 20) - $14,770,000 (74.7%)
o WW1633 (Fund 20) - $5,000,000 (25.3%)
• With the approval of this item and accompanying materials testing contract, the following fund balances will remain in each respective project.
o $7,465,433.42 will remain in Project WA1633.
o $2,861,447.83 will remain in Project WW1633.
